Avangardni Servis Ltd. Avantgarde Service Travel Terms & Conditions


Remarks
These Terms & Conditions of booking and purchase of travel arrangements and services, including accommodation, (furthermore Travel), constitute an integral part of the Agreement/Vouchers concluded between Avangardni Servis Ltd. Avantgarde Service Travel, Sv. Križa 3; 20 000 Dubrovnik, Croatia; OIB 25030544593, registered in the court register of teh Commercial Court in Dubrovnik, MBS: 090024517 and the Client/contractor applying for the Travel, (furthermore Client). The Client, other than a physical person/traveler, may also be a travel organization/tour operator, that is engaged in the organization of a Travel, and in that case these Terms & Conditions shall be applied in accordance with that fact in the part and extent in which they are applicable.

Business Manager

Avantgarde Service appoints Lejla Melkić as the Business Manager. Contact details, authorization, responsibilities and duty time are available in Final Provisions chapter.

General Conditions

This document represents the entire agreement between the Client/contractor and Avantgarde Service, who is the tour operator. Avantgarde Service will be responsible to the Client for supplying the Travel as described at www.avantgardeservice.com or in the other promotional materials published by Avantgarde Service, except where such services cannot be supplied, or the itinerary used is changed due to delays or other causes of whatever kind or nature beyond the control of Avantgarde Service. In such circumstances, Avantgarde Service will do its best to supply comparable services, accommodations and itineraries, and there shall be no refund in this connection. Avantgarde Service act only as an agent for the Client and upon the express condition that Avantgarde Service shall not be liable or responsible for any direct, indirect, consequential or incidental damage, injury, loss, accident, delay or irregularity of any kind, which may be occasioned by reason of any act or omission of any third party (including without limitation, any act, inaction or breach of contract of any third party, which is to or does supply any goods or services for this Travel). Without limiting the foregoing, Avantgarde Service does not own or operate any third party suppliers of services such as hotels, restaurants, transportation companies, sightseeing companies or local tour operators, which are considered to be separate and independent entities, and Avantgarde Service is only eligible if their choice is not made in accordance with the rules of business and best practices in the agency's business. Avantgarde Service is not responsible for any injury, death, loss or expense due to overbooking of accommodations, default of any third parties, sickness, weather, strikes, acts of God, act of Government, acts of terrorism, criminal activity, social unrest, industrial unrest, war, quarantine, force majeure events or any other cause beyond its control. All such risk, loss and expense must be borne by the Client/contractor. Occasionally, it may be necessary to alter or amend itineraries, accommodation and sightseeing arrangements from those published. This may be due to traffic, weather and other operational needs prevailing at the time, and is always made in the best interests of Client´s comfort. Any personal expenses incurred by a Client as a result of any delay, alteration or curtailment of any Travel, whether caused by mechanical defect, strikes or any other cause listed above, are the responsibility of the Client (we strongly recommend all clients take out Travel Insurance; see your licensed travel agent). Avantgarde Service is unable to guarantee exact arrival and departure times, and is not liable for any failure to make connections with any other service, or guarantee the operation of any particular service if not stated different in service description. In the case of breakdown and other unforeseen circumstances, Avantgarde Service reserves the right to substitute vehicles/vessels other than specified, to ensure the operation of a Travel. These vehicles/vessels will be modern vehicles/vessels but may not have some of the features described in product description.
In the event that the Client is not an individual traveler/person but other company/entity engaged in travel organization services, by virtue of which Avantgarde Service is a contractual partner of that company in providing customer service for Travel, Avantgarde Service shall be deemed to be an intermediary in the provision of services. Additionally, Avantgarde Service does not have any direct liability with regard to the actions and parts of the Travel carried out by a third party (carrier, hotel, etc.) in relation to the Client/traveler, regardless of whether they are engaged by Avantgarde Service or not. In the event that any damages to the Client/individual traveler have occurred during the service of the third-party listed herein, Avantgarde Service shall promptly notify the above mentioned Client/travel organization, which is the initial travel organizer, of all necessary data, in order to ensure that any of its potential direct and/or regressive claims should directly target the third party/service provider. The provisions of this paragraph apply unless otherwise agreed with the Client (the travel organizer) and in the event that it is not contrary to the cogent provisions of the law.
These Terms & Conditions do not apply to Travels in a Combined Travel Plan, except in the part of the Passenger Protection in the event of an insolvency of the Avantgarde Service. Combined Travel Plan involves at least two different types of travel services purchased for the same Travel or holiday package that do not represent a package arrangement (eg. separate hotel, airline tickets, transfers and other ancillary services). When providing services for Combined Travel Plan, Avantgarde Service acts on behalf of and for the account of the service provider, or as a licensed sales agent of various service providers (airline companies, hotels, transfers, tourist agency reservation agencies and similar) and each of the service providers is solely responsible for the proper execution of their services in accordance with the contract. In the final travel documents, the traveler/Client will be informed about the contact of the service provider.
However, Avantgarde Service will pay attention to the Client´s rights in accordance with good business practices in tourism; provide information on the reasons for non-compliance with the contracted service and offer possible alternatives. If a Client has caused a problem by negligence or inadvertent, Avantgarde Service may charge a reasonable fee for assistance that will not be higher than the actual cost.
Avantgarde Service does not respond to possible errors in the press, promotional materials or on the website or for any subsequent changes in the new releases of promotional materials and programs that may distract the Client/contractor before the conclusion of the Contract, therefore the relevant information is information contained in the Agreement/Voucher and not the one contained in promotional material.
Please note that if Client arrange for payment through an unaccredited agent, which is not our contractual partner, the unaccredited agent will not be considered as an agent for the purpose of receipt of monies. Receipt of deposits and subsequent payments by the travel agent does not constitute receipt of those monies by us, and the travel agent has no authority, expressed or implied, to receive monies on our behalf. There is no liability on our part, in respect of any monies paid to your travel agent. The company reserves the right to cancel any ticket or booking, or to refuse to carry any Client where payment has not been received by the company within the specified time. The company reserves the right to amend or cancel Travel at any time. These conditions should also be read in conjunction and with reference to general Terms & Conditions for Avantgarde Service Ltd Dubrovnik, Croatia.

Terms of Use

By using www.avantgardeservice.com you agree to be legally bound by these terms, which shall take effect immediately. If you do not agree to be legally bound by all the Terms & Conditions, please do not access and/or use www.avantgardeservice.com website. Avantgarde Service may change Terms & Conditions at any time by posting changes online. Please review these Terms & Conditions regularly to ensure you are aware of any changes made by Avantgarde Service. Your continued use of www.avantgardeservice.com website after changes are posted means you agree to be legally bound by these terms as updated and/or amended. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use www.avantgardeservice.com content (inclusive of text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. We grant you permission to use the site subject to the restrictions in these Terms & Conditions. In accessing or using the site, you may be linked, redirected and exposed to content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. Avantgarde Service does not endorse such content, and cannot vouch for its accuracy. You therefore access and use the site at your own risk.

Payments & Cancellations

Avantgarde Service must receive a deposit of 20% of the total program cost before reservations for your independent travel program can be initiated. The balance of payment is due 60 days prior to departure. No reservations are made on your behalf until this deposit has been received. Availability and pricing is subject to change until this deposit is received. All deposits are nonrefundable.
Avantgarde Service accepts two methods of payment:
1. Bank wire transfer
2. Credit card payment (MasterCard, Visa, Diners)

Currency Conversions

All payments will be effected in Euros or US Dollars.

Creditcard purchase security statement

Confidentiality of your information is protected and secured by using SSL encryption. Pages for web payment are secured by using Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a data coding procedure for prevention of unauthorized access during data transfer.
This enables a secure data transfer and prevents unauthorized data access during communication between user and Monri WebPay Payment Gateway and vice versa.
Monri WebPay Payment Gateway and financial institutions exchange data by using their virtual private network (VPN) which is also protected from unauthorized access.
Monri Payments is PCI DSS Level 1 certified payment service provider.
Credit card numbers are not stored by Merchant and are not available to unauthorized personnel.
All payments will be affected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian Kuna according to the current exchange rate of the local Croatian National bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site.
All payments will be affected in Croatian currency. The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.

Privacy and Personal Data Collection

Avantgarde Service is committed to provide service of protection of our Client's personal data in a way that we collect only essential basic information about our Clients that are necessary for fulfilling our obligations. Avantgarde Service collect, store and process customers personal data only with prior obvious and perspicuous customer consent. All user information are strictly protected and are available only to the employees authorized by company GDPR Coordinator. All our employees and business partners are contractually responsible to follow the principles of confidentiality and data protection. Avantgarde Service is in full compliance with Croatian and EU GDPR legislation. Pricing & Inclusions/Exclusions
Prices listed on www.avantgardeservice.com and other promotional materials, are per person, unless otherwise specified. Price quotations are subject to change without prior notice, until a booking has been confirmed. Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax. Prices do not include tips/gratuities to tour directors, drivers or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; and any beverages or food not specifically listed under “Inclusions” on the product pages of www.avantgardeservice.com and other promotional materials.
The price includes those services listed under the "Price includes" and may also include various fees, which are particularly emphasized on the Travel program. The price of the Travel does not include those services that are specially included in the Travel program and listed under "Price does not include" with the notice that some of the optional services can be pre-arranged and will be recorded in the Travel Contract. Avantgarde Service will inform the customer about the existence, price, and any changes in the fee collection regime. The published prices are the result of the Avantgarde Service agreement with partners and do not have to match the prominent prices on the spot in the destination where the customer resides.
Avantgarde Service has the right to increase the price of the Travel if the price increase is solely the direct consequence of the change of: a) the cost of transport of passengers arising from fuel costs or other energy sources, b) the amount of tax or fee for Travel services covered by a contract by authorities or entities not included in the execution of an Travel, including tourist taxes, landing fees or fees for embarkation or disembarkation at ports and airports or c) foreign exchange rates relevant to the Travel arrangement.
Avantgarde Service has the right to unilaterally raise the price of the package to a value of 8% and must notify the customer within 20 days before the Travel. An increase in the price, regardless of its size, is only possible if Avantgarde Service inform the Client/contractor in writing, in clear and understandable manner, with the explanation of this increase and calculation, but no later than 20 days before the beginning of the Travel.

Passport & Visas

Each Client has to check posession of the appropriate documents for the Travel especially (but without limitation) if he/her booked tours, packages or transfers including flight or visit of a country different from the country of departure. Client has to be in posession of a passport (with visa if necessary) or a valid ID card. No refund will be granted in case of lack or loss of ID documents.

Monetary, customs and health regulations

Clients are obliged to abide by monetary and customs regulations, as well as laws and other by-laws of the Republic of Croatia and other countries through which they are travelling and in which they reside. In case of the inability to continue the trip for violation of the regulations by the Client, all incurred costs are borne by the offenders themselves. Travel to some countries requires mandatory vaccinations against certain diseases and the Clients are required to have certificates and vaccination documents.

Circumstances beyond our or our supplier’s control

No compensation of any kind or responsibility can be taken due to circumstances beyond the control of Avantgarde Service or the relevant Travel service providers. Avantgarde Service will notify a change to Client´s Travel arrangements, when we or the relevant service providers cannot supply Travel arrangements in full or in part as agreed, or if Client suffer any loss or damage of any description. A circumstance beyond our or the relevant Travel service providers’ control is one that cannot be foreseen or avoided, even after taking all due care and includes but is not limited to war, terrorist activity, civil unrest, industrial disputes and bad weather conditions or forecasts.

Special Requests

Please inform us at time of booking of any special requests for any service or facility that is not included as part of your Travel. We will enquire with the relevant service provider and where possible will try to accommodate your request, but please note that such services cannot be guaranteed.

Acceptance of Terms & Conditions

It is understood by Avantgarde Service that the Terms & Conditions of travel are accepted by the Client when the required deposit has been paid and/or when he/she has contracted a Travel.

Travel Insurance

It is a condition of our Contract/Voucher with Client that Client and all members of Client´s party have suitable and sufficient travel insurance to cover the Travel as neither Avantgarde Service nor our suppliers can be held responsible for any liability, expenses or losses that incur as a result of being inadequately insured. We strongly recommend that at the time of Travel booking, a comprehensive travel insurance policy is purchased.

Client´s Responsibility

Client is responsible for his/her and their party’s actions. If we or our suppliers reasonably evaluate that Client´s actions or those of their party, could cause danger, upset or annoyance to other customers, guests or staff, we or our suppliers may end your booked Travel arrangements immediately. In this event neither Avantgarde Service nor the relevant service provider(s) will be considered obligatory for compensation, give refunds nor pay any expenses that Client suffer as a consequence. Client is responsible for personal safety and for the safety of the accompanying persons, dependent on the Client. Please take time to understand and then conform to the health and safety rules stipulated by the immediate provider of the Travel service or the facility, or by the appropriate government authorities. The Client / Contractor agrees to protect its affiliates and / or its suppliers and any of their officers, directors, employees and agents from and against any claims, proceedings, claims, reimbursements, losses, damages, gluttons, penalties or other costs, or expenditures of any kind or nature, including but not limited to reasonable legal and accounting charges, undertaken or incurred by:
• Client or on Client´s behalf in excess of the liability described above; or
• by third parties as a result of
- Client´s breach of this agreement or the documents referenced herein;
- Client´s violation of any law or the rights of a third party; or
- Client´s use of Avantgarde Service website and publications.
and to involve/enter/take over such legal cases and to compensate Avantgarde Service for all the damages and expenses that may arise as a result of such a legal action.

Avantgarde Service Responsibility
Avantgarde Service is bound to take care of the performance of the Travel service as well as the choice of service providers, with the attention of good businessman and taking care of the rights and interests of Clients according to good practices in tourism. Avantgarde Service is obliged to provide all contracted services for a particular Travel and to provide solutions to any failure to perform a service or part of the service. Avantgarde Service will perform all of the above obligations from its Travel programs/arrangements completely and in the manner described, except in the case of force majeure or unpredictably changed circumstances. With all our attention, overbooking at the hotel/transport/restaurant may sometimes not be avoided on the destination/travel program and Avantgarde Service will try to offer a replacement solution, depending on the circumstances. Avantgarde Service will provide assistance to Clients with restricted mobility; provide adequate information on health services, local authorities and consular assistance, as well as establish remote communication for finding alternative Travel arrangements. Avantgarde Service may, for assistance in situations where the Client has caused deliberate or negligent difficulty, charge a reasonable fee that will not be higher than the actual cost. The Client is entitled to a reduction of the cost/compensation if the travel services are not performed properly, in accordance with the rules of procedure described in Complaints chapter.

Airport and Port Transfers

Client is responsible for providing precise arrival time and pick up location information (airport, flight number, cruise docking port, hotel address etc.) at least 72 hours before the Travel date to the contact e-mail or phone numbers stated in the booking voucher. Failure to do so can lead to loss of Travel service and Avantgarde Service, its affiliates or the relevant service provider will not be liable for any refunds or penalties.

Itineraries

Itineraries were correct at the time of publishing, but may be subject to change without prior notice. This could come about due to unpredictable circumstances; sea, road or weather conditions or any changes imposed by other tour operators and carriers included in the itinerary. Avantgarde Service reserves the right to change the day or hour of departure due to changes in the flight schedules or occurrence of unforeseen circumstances, as well as the right to change the direction of travel if the conditions of travel change; such as flight time, weather conditions, social unrests or country security, without the payment of damages, and according to the applicable regulations in international traffic.
If Avantgarde Service, except for the effects of the above circumstances, has been forced, prior to the Travel commencement, to substantially modify any of the main features of the Travel service or can not meet the agreed special requirements of the Client/contractor, Client may, within the reasonable time proposed by Avantgarde Service accept the proposed amendment or terminate the Travel contract without paying compensation for termination of contract. If a Client terminates a Travel contract in accordance with the above, Avantgarde Service is obligated without unnecessary delay and within 14 days of termination of the contract, to return all payments to the Client.
If a Client amends the itinerary by starting or concluding the itinerary earlier or later or during an itinerary, then it becomes Client´s responsibility to arrange tour, flight or other connections as necessary.
Client shall not be entitled to compensation for arbitrary interruption of a journey already commenced. Eventual dissatisfaction with the service provided or other reasons for termination are the subject of a separate claim for compensation and reimbursement.

Cruise Itineraries

Itineraries were correct at the time of publishing, but may be subject to change without prior notice. This could come about due to unpredictable circumstances; sea, road or weather conditions or any changes imposed by other tour operators and carriers included in the itinerary. After departure of a cruise, on occasion and due to unforeseen circumstances or circumstances beyond our control, such as exceptionally bad weather, navigational restrictions or other operational difficulty, in the interests of Client´s safety or comfort, the skipper or captain may make required changes to the itinerary at his discretion. Cancelling a port or ports of call or making required changes in the itinerary as a consequence of the occasions stated above, does not entitle Client to any claim against Avantgarde Service, or to any refund. If necessary, an itinerary may be changed or vessel substituted before or after commencement of the cruise. During the holiday, should the yacht/vessel sustain any breakdown in machinery or equipment disrupting the cruise itinerary for more than 24 hours, and if no alternative arrangement or substitute vessel is offered, Clients will be entitled to a proportional refund for those cruise days not completed.
Most changes to Travel arrangements are minor. Occasionally, Avantgarde Service have to make a "significant change". Significant changes include the following changes when made before departure; a change of vessel/yacht or accommodation to that of a lower official classification or standard for the whole or a major part of the cruise or Travel; a change of sailing or accommodation area for the whole or a major part of the cruise/Travel; a change of outward departure time or overall length of cruise/Travel of twelve or more hours, or a change of departure point to one which is more inconvenient for Client. If Avantgarde Service have to make a significant change to or cancel Client´s cruise/Travel, we are obliged to advise Client at earliest convenience. If there is sufficient time for advice before departure, Avantgarde Service will offer Client the choice of the following options:
• accepting the changed Travel arrangements or,
• purchasing alternative Travel arrangements from Avantgarde Service, of a similar standard to that originally booked if available. Avantgarde Service will offer customer at least one alternative of equivalent or higher standard with no additional charges exceeding the price of the original Travel, or refund the price difference if applicable. If alternation is not accepted by Client, Avantgarde Service will offer choice of other available Travel arrangements.
• cancelling or accepting the cancellation in which case Client receives a full and quick refund of all monies paid to us.

Coach Tours Itineraries, Smoking and Seat Rotation

Itineraries were correct at the time of publishing, but may be subject to change without prior notice. This could come about due to unpredictable circumstances; sea, road or weather conditions or any changes imposed by other tour operators and carriers included in the itinerary.
Government regulations prohibit smoking inside tourist coaches within Croatia. The Client is obliged to get informed and, in this respect, require information from staff, crew members or the employees of the immediate service provider. Please restrict smoking to the ample stops en route. To enable everyone the opportunity of enjoying window and front seats, Clients change seats daily during the course of the tour.

Joining Instructions

If Clients Travel includes arrival/departure transfer, Client is advised to contact Avantgarde Service by email at: This email address is being protected from spambots. You need JavaScript enabled to view it. or by other way of communication, and verify pick-up time and pick-up location at least 48 hours prior to the start of Travel.
If Client is not able to confirm pick-up location within the specified time frame, Client is advised to contact Avantgarde Service on +385 99 203 46 51 prior to the Travel, or immediately upon arrival at the destination.
Client ought to confirm and obtain any visa requirements prior to border crossing. All visa requirements and personal ID possesion are the sole responsibility of the Client.
Clients passport details (name, family name, date of birth, nationality and passport number) may be required in advance; therefore Client is advised to send them with the booking reference number by email to: This email address is being protected from spambots. You need JavaScript enabled to view it. or contact Avantgarde Service at phone numbers listed above. Clients are obligated to arrive to the pick-up location or meeting point by themselves.

Tour Amendments and Cancellation

Itineraries were correct at the time of publishing, but may be subject to change without prior notice. This could come about due to unpredictable circumstances; sea, road or weather conditions or any changes imposed by other tour operators and carriers included in the itinerary. If a Client amends itinerary by starting or concluding the itinerary earlier or later or during an itinerary then it becomes Client´s responsibility to arrange tour, flight or other connections as necessary.
Avantgarde Service reserves the right to change the day or hour of departure due to changes in the flight schedules or occurrence of unforeseen circumstances, as well as the right to change the direction of travel if the conditions of travel change; such as flight time, weather conditions, social unrests or country security and other unforeseen circumstances; without the payment of damages, and according to the applicable regulations in international traffic.
If Avantgarde Service, except for the effects of the above circumstances, has been forced, prior to the Travel commencement, to substantially modify any of the main features of the Travel service or can not meet the agreed special requirements of the Client, Client may, within the reasonable time proposed by Avantgarde Service accept the proposed amendment or terminate the Travel contract without paying compensation for termination of contract. If a Client terminates a Travel contract in accordance with the above, Avantgarde Service is obligated without unnecessary delay and within 14 days of termination of the contract, to return all payments to the Client.
Avantgarde Service may terminate the travel contract prior to the start of the Travel arrangement and will fully refund all payments received for the Travel deal, without the obligation to compensate the Client if the number of persons registered for the Travel is less than the minimum number stated in the contract. Avantgarde Service will inform the Client of the termination of the contract within the deadline stated on the web site, promotional material or within the Travel program.
Client shall not be entitled to compensation for arbitrary interruption of a journey already commenced. Eventual dissatisfaction with the service provided or other reasons for termination are the subject of a separate claim for compensation and reimbursement.
If some of the Travel programs and arrangements are subject to special conditions, Avantgarde Service will list them when contracting and apply it.

Cancellation Policy

Written cancellations received less than 60 days prior to departure are subject to the following forfeit of tour cost
• 59-14 days prior to departure, 50% of total tour cost
• 14 or less days prior to departure, 100% of tour cost.

Delays

We regret we are not in a position to offer you any assistance in the event of delay at outward or homeward point of departure. Any airline/carrier concerned may however provide refreshments or other delay compensations. We cannot accept liability for any delay which is due to any of the reasons, which includes the behavior of any passenger(s) who fails to check in or board on time, or responsible for violating security and other legally-based procedures. In addition, for these bookings, we will not be liable for any delay unless it has a significant effect on your Travel.

Safety Standards

The safety standards and regulations are those of the host country, and not necessarily the same or equivalent standards of your country. Monitoring, enforcement and compliance with local regulations is carried out by the appropriate authorities in the country concerned. We urge you to take all reasonable protection precautions whilst on holiday.

Disabilities and Travel

We embrace all people, regardless of nationality, colors or physical conditions. One of our goals is to provide free access and expand travel opportunities for people with special needs in the Croatia and abroad. We are exploring more Travel products to accommodate this special population; however, yet, not all the Travel products we currently offer include special accommodations or appropriate accessibility. Clients are responsible to verify with us before booking the Travel to ensure that special arrangement can be made, if it is required for their needs. Avantgarde Service or local provider is not liable for any incidences or consequences incurred during travel or complaints or lawsuits during or after Travel due to Clients failure to inform us of their special needs. Clients are suggested to re-confirm with us, that special accommodation or facilities will be provided per their request.

Medical Conditions, Pregnancy and Travel

If Client have a medical condition, or if pregnant and considering Travel, client must consult the doctor before the Travel, especially if medical condition requires daily routine care, urgent care, or pregnancy is rated high-risk. Client is responsible for disclosing any related information to us during the reservation/check-out process by adding special comments.
Client understand that Avantgarde Service or local provider is not in a position to provide any medical services or urgent care in the event such an action may be required.
Client is liable for any risks, incidences or consequences incurred during Travel. We highly recommend that Client purchase medical insurance and travel insurance before the Travel.

Responsible Travel Policy

The main goal of the company is to offer all the essentials of the perfect holiday: exceptional value for money, destination knowledge and attention to detail. Within our Personal Travel Advice agenda we provide information to the Clients about recommended behavior and treatment of the animals and provide recommendations for local souvenirs purchase. Our tours include local wine producers, oil producers, cheese producers, local households and family run hotels etc. We are involved in preserving local silk production heritage in Konavle region (near Dubrovnik) and encourage our guests to buy local food and to eat in local restaurants (helping the local people to build their business) Buy local, eat local and live like a local!

Travel Companion

All travel companions parties agree to take the Travel together, on their own will and accord. Disparities financially, culturally, or personally are each party's responsibility to resolve and must not affect the overall Travel in any fashion. If one party cancels their part of the Travel, all additional penalties or charges associated with the cancellation of the departing party's Travel, must be paid by the departing party in full. This ensures the departing party leave the attending parties and their Travel in good standing. Travel companion orders are fully nonrefundable after the payments have been submitted by each travel companion party. Travel companion cannot change departure dates unless all parties consent to the departure date change. Airport transfers for travel companion orders follow the same standards as airport transfers provided on ordinary Travel programs. No additional accommodation alteration to a Travel may be made once the Travel has been confirmed. Additional bedding arrangements will come at additional fees if available and will be the responsibility of the each travel companion party. All parties herein agree to the policies and bindings of a travel companion booking and Terms & Conditions, and have agreed to the continuation of the Travel in each party's good faith and understanding. Multiple pick up locations and times may not be available for all Travels. Travel companion parties must decide on one pick up location to meet at for the Travel (for Travels offering pick up location services) or one airport transfer service time (for Travels offering airport transfer services; one airport and one transfer per party). We suggest the selected pick up location to be equidistant from each travel companion or the selected airport transfer time to be the later of the two airport arrivals (early arrival travel companion should wait for the later arrival travel companion for one transfer).

Important note

Compensation will not be payable if we are found to cancel or in any way change your Travel due to war, or threat of war, riots, civil commotion, industrial disputes, disaster, terrorist activities, technical or other problems with transportation, closure of airports or seaports, alteration or cancellation of scheduled services. Avantgarde Service will not reimburse any Client who changes, or does not utilize any part of the Travel arrangements which they have booked and paid for with this company.

Complaints

Any problems that occur whilst on Travel should be directed at the earliest opportunity to the local supplier, representative and Avantgarde Service Ltd, so it can be rectified. Complaint for irregularities must be directed by the Client Avantgarde Service Business Manager on the spot. In the event that the complaint can be resolved on the spot and the Client did not complain of irregularities on the spot, it is understood that the Client agrees with the service and thereby lost the right to apply later claims with the request price reduction or payment of damages. Avantgarde Service will not consider the complaint if the Client has not provided a copy of the written complaint he has filed on the spot. If there is no improvement after the objection, the Client is required to ask for a written confirmation that the service is not provided or not provided in the manner agreed upon. The Client must enclose the certificate with the written complaint.
Complaints must be submitted in writing to Avantgarde Service Ltd, Sv. Križa 3; 20000 Dubrovnik, Croatia, no later than 30 days after returning from your Travel. If Client submits a written complaint after this deadline, Avantgarde Service is not obligated to take such notice into account. Avantgarde Service is obliged to make a written decision on the complaint within 14 days of the receipt of the complaint and may postpone the deadline for the decision, for the purpose of collection of information, for an additional 14 days. Within the period till decision is being taken, and a total of 14 or 28 days after the submission of the objection, Client irrevocably waives the mediation of any other person, arbitration of UHPA or other institution, as well as providing information to the media. Likewise, during this time the Client waives the right to sue. The highest amount of compensation per complaint may reach the amount of the subject part of the service, and may not include the services already used, nor the total amount of the arrangement. Client and Avantgarde Service will pursue disputes by mutual agreement, otherwise the jurisdiction of the Court in Dubrovnik will be agreed upon. Relevant law will be Croatian law. According to the Law on Provision of Tourism Services, the Client may submit a proposal for solving a dispute before the notified body for alternative dispute resolution in accordance with the law governing alternative dispute resolution.

Governing Law

This website/promotional material has been designed for use within the Republic of Croatia. By accessing this website and/or by contracting any Travel arrangement with Avantgarde Service, Clients agree that the courts in Croatia will resolve any dispute that may arise between Client and Avantgarde Service and that Croatian material law will be applied, excluding the provisions of international private law and the provisions referral to the law of the other countries.

Surveillance

Surveillance of the agency's operations is carried out by the Državni inspektorat, Turistička inspekcija, Šubićeva 29, 10 000 Zagreb.

You need JavaScript enabled to view it. , u daljnjem tekstu agencija Avangardni Servis, pridaje posebnu pažnju zaštiti osobnih podataka svojih klijenata i putnika, u skladu s najboljom poslovnom praksom i važećim hrvatskim i europskim propisima, uključujući i Opću uredbu o zaštiti podataka (Uredba (EU) 2016/679 Europskog parlamenta i Vijeća od 27. travnja 2016.). Cilj ove politike je pružiti svim zainteresiranim stranama sve potrebne informacije o načinu obrade i zaštite osobnih podataka i pravima koje klijenti/putnici u vezi obrade osobnih podataka imaju.

PODRUČJE PRIMJENE

Politika se primjenjuje na sve osobne podatke putnika/klijenata koje agencija Avangardni Servis prikuplja i obrađuje i podataka koje prikupljaju i obrađuju partneri agencije Avangardni Servis u ime i za potrebe agencije Avangardni Servis. Klijentom se smatra osoba koja je od agencije Avangardni Servis zatražila uslugu ili ponudu za uslugu. Osobni podatak je svaki podatak koji se odnosi na pojedinca čiji je identitet utvrđen ili se može utvrditi (Članak 4. Opće uredbe o zaštiti podataka). Obrada podataka znači svaki postupak ili skup postupaka koji se obavljaju na osobnim podacima ili na skupovima osobnih podataka (Članak 4. Opće uredbe o zaštiti podataka). Podatke obrađujemo i čuvamo samo onoliko dugo koliko je potrebno za ispunjenje svrhe za koju su podaci prikupljeni ili koliko nalažu primjenjivi propisi.

U skladu s Općom uredbom o zaštiti podataka, klijent ima sljedeća prava:

Pravo na pristup podacima
Klijent ima pravo dobiti potvrdu obrađujemo li njegove osobne podatke, te ako obrađujemo, ima pravo dobiti sljedeće informacije: informaciju o svrsi obrade, o kategoriji osobnih podataka koje obrađujemo, o primateljima ili kategorijama primatelja podataka koje obrađujemo, o predviđenom razdoblju u kojem će podaci biti pohranjeni ili kriterijima za utvrđivanje tog razdoblja, o pravu da zatraži ispravak, brisanje i ograničenje obrade podataka, o pravu na podnošenje tužbe nadzornom tijelu, informacije o sustavu za automatizirano odlučivanje, poput izrade profila, o zaštitnim mjerama ako se podaci prenose u treću zemlju.

Pravo na ispravak i brisanje
Klijent ima pravo ishoditi ispravak netočnih podataka. Klijent ima pravo ishoditi brisanje podataka, osim ako su podaci nužni za svrhu za koju su prikupljeni ili ih je potrebno čuvati prema važećim zakonskim propisima.
Avangardni Servis ima obvezu obavijestiti klijenta o promjeni ili brisanju podataka napravljenih na zahtjev klijenta.

Pravo na ograničenje obrade
Klijent ima pravo ishoditi ograničenje obrade podataka, pod uvjetima definiranima u Općoj uredbi o zaštiti podataka.
Avangardni Servis ima obvezu obavijestiti klijenta o ograničenju obrade napravljenom na zahtjev klijenta.

Pravo na prenosivost podataka
Klijent ima pravo zaprimiti podatke koje nam je dostavio u strukturiranom, uobičajenom i strojno čitljivom formatu, te ih prenijeti drugom voditelju obrade bez ograničenja.

Pravo na prigovor
Klijent ima u svakom trenutku pravo na prigovor na obradu osobnih podataka.
Klijent ima u svakom trenutku pravo na prigovor na izravni marketing, u kom slučaju podatke više nećemo koristiti u tu svrhu.

Automatizirano donošenje odluka uključujući izradu profila
Klijent ima pravo da se na njega ne odnose odluke temeljene na automatiziranoj obradi, uključujući izradu profila.

NAČIN PRIKUPLJANJA OSOBNIH PODATAKA
Podatke o svojim klijentima prikupljamo na sljedeće načine:

Prikupljanje podataka u poslovnici
Prilikom izrade rezervacije ili ponude, tražimo od korisnika osobne podatke potrebne za rezervaciju ili ponudu.
Korisnik svoje podatke može ostaviti osobno, ili u ime korisnika to može napraviti druga osoba, ili nam korisnik podatke može javiti telefonom ili mailom. Prikupljanje podataka putem weba
Na našim web stranicama prilikom izrade rezervacije ili upita za ponudom, prikupljamo podatke potrebne za izradu rezervacije ili ponude. Klijent nam podatke dostavlja putem obrasca na web stranicama.

Privola klijenta
Privola klijenta znači svako dobrovoljno, posebno, informirano i nedvosmisleno izražavanje želja ispitanika kojim on izjavom ili jasnom potvrdnom radnjom daje pristanak za obradu osobnih podataka koji se na njega odnose (Članak 4. Opće uredbe o zaštiti podataka). Bez privole klijenta nikad nećemo upotrebljavati osobne podatke klijenta ni u kakve svrhe za koje je prema važećim propisima nužna privola.

VRSTE OSOBNIH PODATAKA KOJE PRIKUPLJAMO
Prikupljamo samo one podatke koji su nužni za izvršenje svrhe prikupljanja podataka i u skladu s važećim zakonskim propisima. Podaci koje prikupljamo su: ime i prezime, datum rođenja djece radi ostvarivanja popusta, broj telefona i e-mail adresu radi kontakta, lokacija, spol, državljanstvo, broj putovnice ili drugog odgovarajućeg osobnog dokumenta tamo gdje je to potrebno radi izvršenja zakonskih obveza (npr. kod prelaska granice), broj kreditne kartice ili podatke o drugom sredstvu plaćanja. Zbog prirode putničkih usluga može se dogoditi potreba za obradom posebno zaštićenih kategorija osobnih podataka koji otkrivaju, primjerice, vjerska ili filozofska uvjerenja, članstvo u sindikatu i podataka koji se odnose na zdravlje klijenta i to isključivo u svrhu izvršenja ugovora između agencije Avangardni Servis i klijenta, odnosno obavljanja radnji koje prethode sklapanju ugovora. Smatrat će se da je klijent koji je agenciji Avangardni Servis dao podatak iz posebne kategorije osobnih podataka time izričito iskazao svoju privolu na obradu takvih podataka.
SVRHA PRIKUPLJANJA OSOBNIH PODATAKA
Osobne podatke prikupljamo u sljedeće svrhe:

Radi izvršenja ugovora ili pripreme za izvršenje ugovora
Osobne podatke prikupljamo kako bismo mogli izvršiti uslugu prema klijentu ili kako bismo mogli napraviti ponudu za uslugu klijentu.

Radi obavještavanja korisnika o uslugama i proizvodima
Ako je klijent dao privolu, podatke klijenta možemo upotrebljavati kako bismo klijenta upoznali s našim uslugama i proizvodima koji mogu biti zanimljivi klijentu.

Za interne potrebe
Podatke klijenta čuvamo kako bismo zaštitili legitimne interese klijenta ili naše legitimne interese, a u skladu s važećim zakonskim propisima. To na primjer može uključivati čuvanje podataka klijenta kako bismo na najbolji način mogli odgovoriti na eventualne prigovore klijenata, upotrebu podataka klijenata radi sprječavanja, otkrivanja i procesuiranja zloupotreba na štetu klijenata ili agencije Avangardni Servis, osiguravanja sigurnosti zaposlenika, klijenata, proizvoda i usluga agencije Avangardni Servis , kreiranja usluga i ponuda koje odgovaraju potrebama i željama klijenata, osiguravanja vrhunskog korisničkog iskustva, personalizirane korisničke podrške, istraživanja i analize tržišta, optimizacije prodajnih kanala itd. Pravna osnova za obradu podataka u ove svrhe jest legitiman interes agencije Avangardni Servis, osim kad su od tog interesa jači interes ili temeljna prava i slobode koje zahtijevaju zaštitu podataka klijenta i/ili pravna osnova zaštite ključnih interesa klijenta ili druge fizičke osobe. Iznimka su slučajevi kada je pravna osnova privola.

U svrhu ispunjenja zakonskih obveza
Na temelju pisanog zahtjeva utemeljenog na važećim propisima, agencija Avangardni Servis je nadležnim državnim tijelima (npr. sudovima, policiji, turističkoj inspekciji itd.) obvezan dostaviti ili omogućiti pristup određenim osobnim podacima klijenata.
Pravna osnova za obradu podataka u ove svrhe jest ispunjavanje zakonskih obveza agencija Avangardni Servis.
PROSLJEĐIVANJE PODATAKA TREĆIM STRANAMA
Podatke klijenata prosljeđujemo trećim stranama u sljedećim slučajevima:

U svrhu izvršenja ugovora ili priprema za izvršenje ugovora s klijentom
Podatke prosljeđujemo trećoj strani kad je to potrebno da bismo klijentu pružili ugovorenu uslugu ili tražene informacije. To na primjer uključuje slanje podataka klijenta hotelu ili prijevozniku, kada je to potrebno da bi se izvršila usluga ili napravila ponuda za uslugu.

Kada je korisnik dao privolu
Podatke prosljeđujemo trećoj strani ako je to potrebno za svrhu za koju je korisnik dao izričitu privolu.

Kada za obavljanje pojedinih poslova angažiramo podizvođače
Ako za obavljanje pojedinih poslova angažiramo podizvođače kao izvršitelje obrade, u tom slučaju prosljeđujemo osobne podatke podizvođaču. Pritom koristimo podizvođače isključivo izvan prostora EU i ti podizvođači rade isključivo po nalogu agencija Avangardni Servis i po ugovoru sklopljenom s agencija Avangardni Servis, što osigurava mjere zaštite podatka kao da podatke obrađuje agencija Avangardni Servis.

ZAŠTITA OSOBNIH PODATAKA
U svrhu zaštite osobnih podataka svojih klijenata koristimo najbolje poslovne prakse u području turizma i informacijsko-komunikacijskih tehnologija.
Kontinuirano prilagođavamo naše interne procese kako bismo postigli optimalnu razinu zaštite osobnih podataka. Pritom koristimo različite organizacijske mjere i tehnička sredstva zaštite podataka korisnika od neovlaštenog uvida, promjene, gubitka, krađe ili druge zloupotrebe podataka.

Izmjene, dopune i prijelazne odredbe Politike
Politika stupa na snagu i počinje se primjenjivati na dan objave te je dostupna na internetskim stranicama i na prodajnom mjestu agencija Avangardni Servis. O mogućim izmjenama i dopunama Politike klijenti će biti pravovremeno obaviješteni, uključujući i putem objave na internetskim stranicama. Pravo na prenosivost osobnih podataka, brisanje podataka i ograničenje obrade osobnih podataka klijent ima najkasnije od početka primjene Opće uredbe o zaštiti osobnih podataka, tj. od 25. svibnja 2018. godine.

Koje osobne podatke prikupljamo u web shopu
Kada posjetitelji kupuju u našem web shopu mi prikupljamo podatke prikazane u formi blagajne / Podaci za plaćanje.
